Decide what kind of home care business you are building

Before any filing, decide whether you will employ caregivers as an agency or refer independent contractors as a registry, because that choice shapes every registration after it.

Pennsylvania licenses both models under the same chapter, and the definitions differ by only a few words: an agency supplies or schedules employees, a registry supplies or refers independent contractors. Choose an entity type and check the name first

Most home care founders form an LLC so the business, not their household, holds the license and the employer obligations; check the name is free before paying any fee.

A sole proprietorship needs no state formation filing, and some owners start that way to save the fee. The trouble is that in home care the liabilities are unusually personal: a caregiver hurt lifting a client, a family alleging neglect, a wage claim. Without an entity, all of that attaches to you directly.

File the Certificate of Organization to create the LLC

A Pennsylvania LLC comes into existence when the Department of State files its Certificate of Organization, form DSCB:15-8821, submitted with a docketing statement and a $125 fee.

The certificate itself is short. It asks for the company name with a designator such as "LLC", the registered office, the name of each organizer, and an effective date. Give the LLC a registered office or use a commercial provider

Every Pennsylvania LLC needs either a registered office street address in the state or a commercial registered office provider named on its certificate; a post office box alone will not do.

The registered office is where official notices and lawsuits go. If you use your home address, it becomes part of the public record, which some home care owners are uncomfortable with given that their business involves vulnerable clients and sometimes unhappy families.

A commercial registered office provider, or CROP, lets you list a provider's name and your county of venue instead of a street address. That keeps your home off the certificate. Register a fictitious name if the brand differs from the LLC

If you will trade under any name other than the LLC's exact legal name, Pennsylvania requires a fictitious name registration, which costs $70 at the Department of State.

Get the EIN, then open the bank account

Calendar the annual report before you forget the LLC exists
